Terms & Conditions

By accessing maya-interaktive.ro or using any of Maya Interaktive's services, you expressly accept these Terms and Conditions. Please read carefully before using our platforms and services.

1. Company Information

Maya Interaktive SRL is a Romanian company based in Cluj-Napoca, providing integrated digital and classic marketing, branding, ATL & BTL advertising, social media management, video production and strategic consulting.

2. Acceptance of Terms

By using our services, website, or communicating with our team regarding a service contract, you confirm that you have read, understood and fully accepted these Terms and Conditions, and that you have full legal capacity to enter into agreements.

3. Services Offered

3.1 Digital Marketing

Paid advertising campaigns (Meta Ads, Google Ads, TikTok Ads), SEO, email marketing, content marketing and social media management.

3.2 Branding & Visual Identity

Brand identity creation: logo, graphic materials, brand guidelines, UI/UX design and visual communication materials.

3.3 ATL & BTL

Media planning and buying, TV/Radio production, outdoor (OOH), print and BTL activations. Event organization and promotional campaigns.

3.4 Strategic Consulting

Marketing audit, integrated communication strategy, market research, competitive analysis and long-term campaign planning.

4. Contracting and Quotations

Maya Interaktive services are provided exclusively based on a written contract signed by both parties. Any quotation is valid for 30 calendar days from the date of issue, unless otherwise specified.

Prices are expressed in RON or EUR and are exclusive of VAT unless stated otherwise. VAT is added according to current legislation.

5. Payments and Invoicing

  • Advance of 50% of total value upon signing the contract or accepting the offer
  • Remaining 50% upon final delivery or according to contractually agreed milestones
  • Invoices are issued electronically with a payment term of 15 working days
  • Late payment attracts penalties of 0.1% per day on the overdue amount
  • Maya Interaktive reserves the right to suspend services for payments overdue by more than 30 days

6. Intellectual Property Rights

All creative materials, concepts, strategies and deliverables produced become the Client's property after full payment of all amounts due.

Maya Interaktive reserves the right to use completed projects in its portfolio and for promotional purposes, unless the Client explicitly requests confidentiality and this is stipulated in the contract.

7. Client Responsibilities

The Client agrees to: provide all necessary materials and access in a timely manner; designate a responsible contact person; provide feedback within agreed timelines (generally 5 working days); guarantee ownership rights to all materials provided; and meet payment deadlines per the contract.

8. Limitation of Liability

Maya Interaktive cannot guarantee specific results in marketing campaigns, as these depend on external factors. Total liability shall not exceed the amount paid in the last 3 months of collaboration. Maya Interaktive is not liable for indirect damages, loss of profit, data loss or reputational damages.

9. Confidentiality

Both parties agree to maintain confidentiality of all commercial, strategic and technical information exchanged during the collaboration. This obligation continues for 3 years after contract termination.

10. Termination

Either party may terminate the contract with 30 days' written notice. Upon termination, the Client owes payment for services rendered up to the effective termination date.

11. Governing Law

This agreement is governed by Romanian law. Any disputes shall first be resolved amicably. In case of failure, jurisdiction belongs to the competent courts in Cluj-Napoca, Romania.

3. Essential Cookies

These cookies are necessary for the correct functioning of the site and cannot be disabled. They store no personally identifying information and are only activated in response to your actions (e.g., setting the color theme, choosing the language).

4. Analytics Cookies

We use Google Analytics to understand how visitors interact with our site. All data is anonymized and aggregated — we cannot identify individual users. Information collected includes: pages visited, session duration, country of origin (regional level), device type and browser.

5. Marketing Cookies

2.1 Data provided directly by you

Through the contact form or within a contractual relationship, we collect: name and surname, email address, phone number, company name and position, and the content of messages and requests sent.

2.2 Automatically collected data

By navigating the site, we automatically collect (via cookies and analytics tools): anonymized IP address, browser type and operating system, pages visited and session duration, traffic source, and theme/language preferences (stored locally).

3. Purposes of Processing

  • Responding to requests — processing necessary for contract execution or at the request of the data subject (Art. 6(1)(b) GDPR)
  • Contract execution — invoicing, service delivery, operational communication (Art. 6(1)(b) GDPR)

5. Data Retention

  • Contractual and financial data: 10 years (per Tax Code)
  • Quote requests (not converted to contracts): 2 years
  • Analytics data (Google Analytics): 26 months
  • Marketing communications: Until consent is withdrawn

6. Data Recipients

We may share your data exclusively with: Google LLC (analytics, transfers under SCC), Meta Platforms Inc. (conversion tracking, under SCC), EU-based cloud hosting providers, and public authorities only as required by law.

We do not sell or transfer your data to third parties for commercial purposes.

7. Data Security

We implement appropriate technical and organizational measures including SSL/TLS encryption, role-based access control, encrypted backups, internal security policies and staff training.

In case of a security incident that may affect the rights of data subjects, we will notify the ANSPDCP within 72 hours and affected persons without undue delay.

8. Complaints

If you believe we are processing your data incorrectly, you have the right to file a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP):
